Where a canton law, judgement, or decision is held to be incompatible with a federal law, cantonal Laws, decisions, and judgments (one upheld by a cantonal Constitutional Court) shall prevail.
If a cantonal Constitutional Court, in interpreting this Basic Law, proposes to derogate from a decision of the Federal Constitutional Court, it shall seek to obtain the consent of the Federal Constitutional Court within 90 days. Absent such consent, the decision of the cantonal constitutional court shall prevail.
